Compromising evidence
In 2017, the NABU searched Trukhanov’s apartment and launched an investigation into his activities as mayor of Odesa (he is suspected of embezzling 185 million hryvnias from the city budget).
On February 14, 2018, Trukhanov and his deputy Pavlo Vugelman were detained upon arrival in Ukraine, but later the court released them both on bail. Trukhanov was bailed out by Petro Poroshenko Bloc MP Dmytro Holubov, and Vuhelman was bailed out by Oleksandr Pressman of the Revival Party and Yuriy Miroshnychenko of the Opposition Bloc faction. The NABU and the SAPO suspected the mayor of Odesa and several other local officials of embezzling UAH 185 million from the city budget: the buildings of the Krayan plant were purchased for the city hall at an inflated price. The amount was later halved. Prosecutors demanded 12 years in prison for Trukhanov and 11 years for his deputy, Pavlo Vugelman.
On March 31, 2018, the anti-corruption authorities completed the investigation and prosecutors concluded that the evidence collected was sufficient to draw up an indictment against Trukhanov, Odesa officials and others suspected of embezzling city budget funds.
On July 9, 2019, the Malynovskyi District Court of Odesa acquitted Gennadiy Trukhanov and other officials of the Odesa City Council in the case of financial fraud during the purchase of the Krayan plant buildings.
Trukhanov is also accused of making false declarations.
COMPANY HEADED BY MAYOR’S DAUGHTER GENNADIY TRUKHANOV LEASED LAND IN THE CENTER OF ODESA FOR NOTHING
The Anti-Corruption Action Center reported that the company Squo LLC, owned by the daughter of Odesa Mayor Gennadiy Trukhanov, with the help of her father, leases land in the center of Kyiv for a small sum of money — 40 thousand UAH per year.
According to journalists, on December 27, 2004, Squaw LLC and the Odesa City Council signed a land lease agreement: “Squaw received 8302 square meters of land for 49 years. The normative monetary value of the land was only UAH 4 million, and the rent was only UAH 40,000 per year. Andriy Ivancho is a co-owner of Skvo LLC. The head of this company since November 2015 is Kateryna Trukhanova, the daughter of Gennadiy Trukhanov.
After 10 years, the Odesa City Council decided that the rent for land use was too low. On 18.06.2014, the Commercial Court of Odesa Region granted the City Council’s claim to amend the lease agreement. According to the monetary valuation of the land carried out in 2011, the value of the plot was estimated at UAH 47600000 instead of UAH 4, and the rent (3% of the monetary value) amounted to UAH 1400,000, which is 35 times higher than the original terms of the agreement. However, this decision was overturned by the Odesa Commercial Court of Appeal. Formally, the court agreed that the amount of rent was unsatisfactory. However, since the cadastral number of the land plot specified in the lease agreement and the Certificate of Monetary Valuation did not match for some reason, the lease price was not changed.
The city council did not react to the court’s decision.
The lawyers of the Anti-Corruption Action Center note that Trukhanov has been directly involved in the decision-making of the Odesa City Council since 2005. At the very least, local officials did not timely amend the lease agreement, which was unfavorable to the city, did not provide relevant documents during the appeal, and did not conclude a lease agreement with the Ark Palace condominium. All indications are that Trukhanov committed a crime under Art. 364 of the Criminal Code of Ukraine (abuse of power or office), which manifested itself in the use of the mayor’s position to benefit the company headed by his daughter.
Odesa airport
In December 2016, NABU investigators raided the long-suffering Odesa airport.
This facility was at the center of a scandal back in the summer of 2011. The Odesa City Council, headed by then-Mayor Oleksiy Kostusev, unexpectedly voted to establish a joint venture with the company of two well-known businessmen in the city, Boris Kaufman and Oleksandr Granovsky.
The city contributed the entire property complex of the municipal airport to the authorized capital of the newly created Odesa International Airport LLC, and Kaufman-Granovsky contributed UAH 355000000. Additionally, the latter undertook to attract up to 120000000 dollars of investment to repair the terminal and runway.
It would seem that Odesa signed a good contract and got an investor. But there were nuances.
First, the authorities invested in the airport property at book value, which is several times cheaper than its real value. As a result, the city did not control 100% of the airport, as it had previously, or even 50%, as one might assume, but only 25%.
Under such circumstances, the authorities could not make decisions on the development of the asset or withdraw from the joint venture without incurring large losses.
Secondly, the money that Kaufman and Granovsky contributed to the authorized capital of Tolk was not authorized to be paid there. According to the investigation, much of this money had already been used as a guarantee for loans to other companies. And such schemes are expressly prohibited by law.
The situation remained “stable” until the fall of 2014. Then the Odesa City Council filed a lawsuit to regain ownership of the airport property.
The proceedings lasted until the summer of 2015, but in July of that year, the court actually granted the city council’s request and canceled the clauses of the agreement between the city and the “investors” that referred to the transfer of the airport property in good faith.
And at this stage in the history of Odesa airport, one of the key characters is the mayor elected in 2014, Gennadiy Trukhanov.
Kaufman and Hranovsky appealed to the Court of Appeal in order not to lose their “investments,” but it did not come to a court decision — Trukhanov signed a settlement agreement with them.
The NABU believes that he did not have such authority and acted in collusion with the “investors.” Investigators estimate the losses from this deal at UAH 100,000,000.
In December 2016, investigators seized documents at the airport and city hall, and on October 23, 2017, they seized documents from the mayor’s apartment in Odesa. According to local media, the NABU took two packages of documents from Trukhanov.
The SBU is interested in Trukhanov and Filimonov’s “clones” in the Odesa elections
In the Odesa region, on the eve of the local elections, several people filed documents with the names “Gennadiy Trukhanov” and several candidates with the name “Filimonov”. This issue was investigated by the Office of the Security Service of Ukraine in Odesa region.

The Security Service of Ukraine in Odesa region opened a criminal investigation into the obstruction of the exercise of the right to vote by a group of persons or a member of an election commission or other official using their official position (Article 157(3) of the Criminal Code of Ukraine).
Thus, the SBU became interested in the attempts of the namesakes of the current mayor, Hennadii Trukhanov, and his opponent from the Servant of the People party, Oleh Filimonov, to register as mayoral candidates.
The SBU also demanded that the TEC hand over copies of these papers.
TRUKHANOV HID HIS MOTHER’S RUSSIAN APARTMENT WITH WHOM HE LIVES IN HIS DECLARATION
Reporters from Slidstvo.info and OCCRP reported on the undeclared apartment of the mother of Odesa Mayor Gennadiy Trukhanov. The address of the apartment is Moscow, Lomonosovsky Avenue 18, apartment 550. According to the official Russian real estate register, this apartment is owned by Maria Dmytrivna Trukhanova, the mother of the Odesa mayor.
Since Trukhanov lives with his mother, Ukrainian law requires him to declare his property as well. However, the Russian apartment has never appeared in Trukhanov’s declaration, although his mother has owned it since 2003. Before she retired, Maria Trukhanova worked for 25 years at a state hospital, which usually means not much income, and she probably could not have bought an apartment at her own expense. Today, the price of an apartment in a building on Lomonosovsky Avenue in Moscow ranges from $300,000 to $900,000.

ODESA CITY HALL PURCHASED A CEMETERY FOR UAH 146 MILLION AT AN INFLATED PRICE
The National Investigations Center of Ukraine informs that by the decision of the Odesa City Council in September 2016, under the guise of acquiring a land plot for cemetery expansion, 6025 square meters of non-residential premises of Odesa Airlines LLC, located on the leased land of the Odesa City Council, were acquired for UAH 150 million, which does not correspond to the estimated value. The above gives reason to believe that there are signs of embezzlement of budget funds.
According to journalists, the acquisition of this “land plot” was initiated by Gennadiy Trukhanov and Oleksiy Spektor, Head of the Communal Property Department of the Odesa City Council.
«There are practically no places for burial in our city. I don’t want to scare anyone now, but in recent months we have had a serious problem with this issue,» Trukhanov said a few years ago.
However, the Council did not acquire land, but unfinished premises on its own site. The premises were transferred to the balance sheet of the Department of Communal Property, headed by Oleksii Spektor.
Since 2018, the criminal proceedings have been under NABU proceedings No. 42016101010000308, according to journalists, the SAPO has assessed the acquired non-residential premises and found that their value is estimated at almost UAH 13 million. In addition, the territory and the acquired premises have not been used for the specified purposes for 3 years.
According to the court ruling, investigators believe that the established circumstances of the case give grounds to believe that officials of the Odesa City Council, in prior conspiracy with representatives of commercial enterprises, seized budget funds of the Odesa territorial community in particularly large amounts.
800,000,000 EMBEZZLED BY TRUKHANOV’S ENTOURAGE ON ROAD TENDERS IN ODESA
The court granted 17 motions of the National Anti-Corruption Bureau for access to and seizure of documents in the case of possible embezzlement of budget funds by Odesa Mayor Hennadiy Trukhanov, officials of the City Council, Rostdorstroy LLC and other companies. Criminal proceedings №52016000000000123 were registered on 28.04.2016. Under Part 5 of Article 191 of the Criminal Code. It is known that the court granted access to the documentation on the 2015 tenders for the repair of Sakharova and Marselskaya streets, which were won by Rostdorstroy.
In 2014-2016, the Capital Construction Department and the Road Construction Department signed contracts with Rostdorstroy for UAH 437 million, SK Avtobud for UAH 241 million, Kyivdrobud LLC for UAH 52 million, BVK Pik-Bud LLC for UAH 52 million, and DRSU-Kom LLC for UAH 2500000. These companies are controlled by the entourage of Mayor Gennadiy Trukhanov.
One of the resolutions states that the embezzlement of funds was carried out by incomplete performance of works and overstatement of their volume and cost, and the tender procedures were formal, contracts were concluded only with companies controlled by Mayor Trukhanov and representatives of the city council. Detectives believe that funds from these companies were transferred outside Ukraine, to offshore companies. NABU estimates the amount of embezzlement of local budget funds at over UAH 800 million.
After the NABU obtained permission to access the tender documents, Rostdorstroy won two more tenders in October from the Road Construction Department of the Odesa City Council for the overhaul of the city’s roads by the end of 2017 for a total of UAH 158,480,000.
The Capital Construction Department of the Odesa City Council is headed by Borys Panov, and the Road Construction Department is headed by Andriy Byut.
“Rostdorstroy is registered with the Virginia offshore company Sideline International Limited, whose beneficiaries are a reputable businessman Oleksandr Zhukov from London, Odesa City Council member Yuriy Schumacher (Gennadiy Trukhanov’s Trust the Deeds party), Oleksandr Ratskevych and Yevhen Konovalov.
Earlier, as part of the Panama Papers project, documents were made public that Schumacher and Trukhanov owned the Virginia offshore company Corderoy Trading Limited. In his 2015 e-declaration, Hennadiy Trukhanov claims that he does not own any companies abroad.
TRUKHANOV LEASED EIGHT PREMISES FOR THE FAMILY BUSINESS OF HIS LAWYER DEPUTY
On November 23, 2017, Odesa Mayor Gennadiy Trukhanov signed an order to lease eight non-residential premises to Naskar LLC, which belongs to Trukhanov’s entourage. This was reported by Kateryna Madens, a member of the Anti-Corruption Office (Odesa).
All of the leased facilities are located in municipal educational institutions and will be used for driver training courses.
The co-owner of Naskar is Andrii Kutsenko, the husband of Iryna Kutsenko-Yesenovych, a member of the pro-mayor faction in the Odesa City Council, Trust the Business. In her income tax return, Iryna Kutsenko-Yesenovych did not indicate her husband’s business, but only his salary as the head of Naskar LLC. Trukhanov has Russian citizenship
The current mayor of Odesa, Gennadiy Trukhanov, still has a valid passport of a citizen of the Russian Federation.

MP from the Servant of the People faction Oleksiy Leonov said that he initiated the creation of a parliamentary provisional investigative commission to investigate the violations of the Constitution and laws of Ukraine by Odesa Mayor Hennadiy Trukhanov more than two months ago. The MP noted that Speaker Dmytro Razumkov was slowing down the adoption of this decision.
The MP listed several reasons why an urgent investigation into the activities of the mayor of Odesa is necessary.

On November 17, the Odesa Territorial Election Commission announced the results of the second round of mayoral elections: Gennadiy Trukhanov was once again elected mayor. He has held this position since 2014.
He received 54.28% (or 94,921 votes). However, the voter turnout was only 25%. His competitor from the Opposition Platform — For Life party, Mykola Skoryk, received 72,974 votes.
Another six thousand ballots were invalidated. Voters spoiled them because there was no “against all” box.

According to Ukrinform, a statement on filing a lawsuit to recognize the decision of the historical and toponymic commission of the city council as unlawful was published by the Odesa city organization of the European Solidarity party.
“The Odesa territorial organization of the European Solidarity party is suing Hennadiy Trukhanov for trying to rename Heavenly Hundred Avenue,” the statement reads.
The document notes that the attempt to rename the avenue and return it to its Soviet name is a direct violation of the laws of Ukraine, so such an initiative has no legal prospects.

Most of the gang members were never charged because their crimes were not committed in Italy, the newspaper notes. The investigation was later dropped.
Trukhanov returned to Odesa to start his political career, Angert settled in London, and Fomichev moved to Belgium.
The materials of the international law firm Appleby, known as the “Paradise Islands Archive,” indicate that Alexander Popivker, a London-based accountant who is married to Agert’s sister, created and managed dozens of offshore companies of the Rubicon Group, the publication found out. Trukhanov allegedly had large stakes in four of them.
Since 2001, the group has purchased a number of apartments in London through offshore companies, including a £12.5 million (about UAH 440 million) apartment, the investigation claims.
Trukhanov denied this information in a comment to journalists. He noted that it “undermines his honor, dignity and reputation.”
Suspicious Trukhaniv plant to build roads in Vinnytsia region as well
An Odesa-based company has won a tender for road repairs in Vinnytsia Oblast by submitting documents for a plant that cannot be confirmed to exist.
“Three contracts totaling UAH 306 million for the repair of 13 km of the highway… were awarded to Rostdorstroy LLC. The company has been associated with Gennadiy Trukhanov, now the mayor of Odesa, for many years,” the journalists note.
The company’s beneficiaries are currently listed as Oleksandr Zhukov and Oleksandr Ratskevich. However, until recently, its co-owner was also Yuriy Schumacher, a business partner of Odesa Mayor Gennadiy Trukhanov.
According to the publication, participants in such tenders in Vinnytsia region must have a plant located no further than 150 km from the repair site. This should guarantee fast and stable delivery of asphalt.
One of the plants that Rostdobud submitted for most of the tenders is allegedly located in the village of Stryzhavka near Vinnytsia.
However, according to journalists, there is no plant at the address indicated in the documents, and even the village head does not know about it.
“The police also did not find the plant at the place indicated in the documents: at the request of activists, the National Police conducted an inspection in May and recorded the absence of the plant indicated in the documents submitted for the tender,” the investigation says.
Criminal proceedings were initiated over these facts under Part 1 of Article 366 of the Criminal Code (forgery).
The residents of Odesa claim that the plant was there, but not for long — after geological research, it was decided to move it.
“However, Rostdorstroy was unable to provide any confirmation that the plant was really there in the winter, such as photographs,” the journalists note.

Trukhanov complained about Ukraine to the ECHR

Odesa Mayor Hennadiy Trukhanov has filed a complaint against Ukraine with the European Court of Human Rights. This was reported on July 9 by the press service of the law firm Equity, which represents him.
According to the press service, on June 6, the ECHR accepted for consideration the mayor’s application regarding his detention by law enforcement officers in February 2018 at Boryspil airport.
Trukhanov believes that in this case, Article 5 of the Convention for the Protection of Human Rights and Fundamental Freedoms (on the right to liberty and security of person) was violated.
On February 14, Trukhanov arrived on a flight from Warsaw to Kyiv Boryspil Airport, where he was detained by border guards and handed over to detectives of the National Anti-Corruption Bureau of Ukraine (NABU).
The mayor was served a notice of suspicion of causing damage to the city budget of Odesa. According to the investigation, in September 2016, the Odesa City Council purchased the building of the Krayan plant for UAH 185 million from a private entity, which in early 2016 bought it at an auction organized by the company’s liquidator for UAH 11.5 million.

In the apartment where the search was conducted, they found personal belongings of the Odesa mayor, “namely clothes, shoes, documents, electronic media, etc.”
In particular, investigators seized two Pivdennyi Bank cards issued “in the name of Gennadiy Trukhanov, valid until 05.18” during the search.
