The Lviv District Administrative Court has suspended proceedings in the case filed by Member of Parliament Yevhen Petruniak against the National Agency on Corruption Prevention (NACP). The lawmaker is attempting to overturn the findings of an audit into his 2022 asset declaration, in which the agency identified discrepancies worth millions of hryvnias, including undisclosed details regarding a property in Spain.
The lawsuit stems from NACP report No. 499/25, issued on July 4, 2025. The agency concluded that the MP submitted inaccurate information in his financial disclosure. Specifically, auditors found a discrepancy in the size of Spanish real estate acquired by his wife: the declaration listed the apartment at 130.84 square meters, whereas the audit established its actual size as 185 square meters. Additionally, Petruniak failed to report an advance payment of $200,000 (approximately 7.3 million UAH) received from a house sale.
In his lawsuit, the MP requests that the court declare the actions of NACP officials unlawful, cancel specific sections of the audit report, and order the agency to publish a revised version. According to the NACP, the total sum of inaccurate data meets the threshold for criminal liability under Part 2, Article 366-2 of the Criminal Code of Ukraine (false asset declaration).
Administrative proceedings were officially initiated on January 12, 2026. During the hearings, Judge Mariia Kedyk considered the plaintiff’s motion to suspend the case until the completion of a separate criminal investigation opened against him in April 2025 under Part 1, Article 366-2 of the Criminal Code.
However, the court halted the case on different procedural grounds. The Supreme Court recently referred a similar case (No. 420/3078/25) to the Cassation Administrative Court to address a systemic legal question: whether an NACP audit report can be challenged in an administrative court once criminal proceedings based on that report are already underway.
Citing the identity of the legal relationships involved, the Lviv court decided to suspend Petruniak’s case until the Supreme Court issues a definitive ruling on the precedent.
